Article 1: APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE

The website Champagne Stanislas Bonafé, accessible at www.champagnestanislasbonafe.com , is an e-commerce website published by the company CHAMPAGNE STANISLAS BONAFÉ, a S.A.R.L with a share capital of 350 000 €, whose registered office is located at 2 bis rue Jules Lobet, registered under number Reims B 823916945 with the Trade and Companies Register (RCS) of Reims. These General Terms and Conditions of Sale (hereinafter the “GTC”) set out the respective rights and obligations of Champagne Stanislas Bonafé and its Buyers (as this term is defined below) in the context of online sales by Champagne Stanislas Bonafé on the Website, in accordance with the terms and pricing conditions indicated by Champagne Stanislas Bonafé.

The offers available on the Website are strictly reserved for private customers, it being specified that such customers are understood as any natural or legal person having the minimum age required under the applicable regulations and entering into a contract solely for their own needs and not for commercial resale purposes (hereinafter referred to as the “Buyer”), and whose delivery and billing address is located in mainland France, Corsica, or Monaco. Champagne Stanislas Bonafé declines all responsibility with regard to the application of and compliance with any regulations other than French law.

The simple act of placing an order or accepting an offer from the company CHAMPAGNE STANISLAS BONAFÉ implies unconditional acceptance by the Buyer of all the provisions set out in the GTC. The Buyer acknowledges being fully informed that their agreement regarding the content of the GTC does not require a handwritten or electronic signature of a document.

The GTC apply exclusively to all sales concluded by the company CHAMPAGNE STANISLAS BONAFÉ on the Website, except where a specific mention indicated on the Website relates to the exceptional nature of certain Products.

The GTC as well as all elements appearing on the Website (photographs, catalogs, notes, etc.) may be modified at any time and without prior notice by the company CHAMPAGNE STANISLAS BONAFÉ; however, the GTC and prices that shall apply to the sale and be enforceable against the Buyer are those accepted by the Buyer at the time of confirming their purchase and restated by the company CHAMPAGNE STANISLAS BONAFÉ in its order confirmation.

As the company CHAMPAGNE STANISLAS BONAFÉ may be required to amend certain provisions of the GTC from time to time, it recommends that its customers systematically and thoroughly read the GTC before placing any new order.

Article 2: ORDERS

2-1. STANDARD ORDERS

The offers are valid while stocks last and the company CHAMPAGNE STANISLAS BONAFÉ therefore reserves the right to apply restrictions on the quantities requested.

French is the only language offered for placing orders.

The company CHAMPAGNE STANISLAS BONAFÉ reserves the right to refuse, reduce, or split all or part of an order from a Buyer if the quantity ordered or the frequency of their orders appears abnormal in relation to the normal needs of private customers.

The company CHAMPAGNE STANISLAS BONAFÉ reserves the right to cancel, suspend, or refuse any order from a Buyer with whom there is an existing dispute relating to the payment of a previous order, until full payment of the latter.

The Buyer accepts and expressly acknowledges that they waive the benefit of Article 1587 of the French Civil Code.

In the case of a quotation, the offer will remain valid for seven calendar days unless otherwise stated on said quotation.

2-1.1: DESCRIPTION OF PRODUCTS

The company CHAMPAGNE STANISLAS BONAFÉ takes the utmost care in providing information on the Products, particularly regarding their essential characteristics, which are presented in each Product sheet reproduced on the Website, consisting notably of a photograph of the Product and a technical description. The photographs illustrating the Products are not contractual and in no way engage the responsibility of the company CHAMPAGNE STANISLAS BONAFÉ. The technical sheet of the Product is the only contractual source of information. Buyers are informed that the company CHAMPAGNE STANISLAS BONAFÉ may update or supplement its technical sheets at any time. It is specified that a change in labeling does not constitute a modification of the characteristics of a Product.

2-1.2: AVAILABILITY OF PRODUCTS AND SPECIFIC SERVICES

2-1.2.A. The offers are valid while stocks last.

The maximum period for bringing an action under the statutory legal warranty of conformity is one year from the delivery of the Products, under storage conditions for the wine that comply with the Champagne appellation. The Buyer may choose between repair or replacement of the non-conforming Products, provided that the replacement does not entail a clearly disproportionate cost for the company CHAMPAGNE STANISLAS BONAFÉ, taking into account the value of the Product or the significance of the defect.

Any lack of conformity that appears within a period of twelve (12) months from delivery of the Product is presumed to have existed at the time of delivery, unless proven otherwise. The legal warranty of conformity applies independently of any commercial warranty that may be granted by the company CHAMPAGNE STANISLAS BONAFÉ. The Buyer may also invoke the warranty against hidden defects of the Products sold. In such a case, they may choose either to rescind the sale or to obtain a reduction in the sale price.

The company CHAMPAGNE STANISLAS BONAFÉ undertakes to confirm the Buyer’s order by e-mail within a maximum period of 7 days from receipt of said order.

In the event of total or partial unavailability of the Products by the delivery deadline indicated on the order confirmation, the company CHAMPAGNE STANISLAS BONAFÉ will offer the Buyer either to cancel the order, or to accept delivery of Products of equivalent quality and price, or to wait for the availability and delayed delivery of the ordered Products. Upon receipt of the replacement Products, the Buyer may exercise their right of return, and any return costs will be borne by the company CHAMPAGNE STANISLAS BONAFÉ. In the event of cancellation of the order by the Buyer, the company CHAMPAGNE STANISLAS BONAFÉ will reimburse the sums paid using the same means of payment as that used for the order, within fourteen (14) days from the date of cancellation.

In the event of partial unavailability of the Products not indicated on the Website, the company CHAMPAGNE STANISLAS BONAFÉ may (a) split the order, or (b) send the Buyer the Products available when all the other Products become available.

The company CHAMPAGNE STANISLAS BONAFÉ reserves the right, at any time and at its sole discretion, to withdraw one or more Products and/or accessories from sale.

2-1.2.B CUSTOMIZATION SERVICES

The company CHAMPAGNE STANISLAS BONAFÉ offers the Buyer the opportunity to customize certain boxes and/or bottles. Allow 90 days from the order, after validation, for the goods to be made available.

As part of this specific service, the Buyer undertakes to ensure that the content of their customization message complies with the following rules:

The message must contain between 1 and 20 characters and include only letters from the Latin alphabet (excluding special characters and emoticons) and standard digits.

Customized products are intended for personal use. Any other use (promotional, commercial, advertising or otherwise) is prohibited.

The content of the message must not:

Be illegal, harmful, contradictory, questionable, defamatory, offensive, violent, racist, vulgar, obscene, pornographic, related to religion or politics, unethical, detrimental to human dignity or integrity, threatening, indecent, shocking, disparaging or similar; encourage irresponsible or excessive consumption of alcoholic beverages;

Encourage the consumption of alcohol before the legal drinking age;

Portray sobriety, abstinence or moderate consumption in a negative way;

Portray the consumption of alcoholic beverages as a means of overcoming individual or collective problems, or of preventing, treating, or curing any illness or psychological condition;

Associate the consumption of alcohol with any illegal, antisocial, dangerous, aggressive, or violent behavior;

Suggest that the consumption of alcohol transforms the consumer by making them more intelligent, stronger, and enabling them to succeed socially or sexually;

Suggest that alcohol may be consumed before or while driving any type of vehicle or during an activity that requires a certain degree of concentration to be carried out safely;

Infringe the rights of third parties (including intellectual property rights).

It is not the responsibility of the company CHAMPAGNE STANISLAS BONAFÉ to approve the customization message generated by the Buyer: the company CHAMPAGNE STANISLAS BONAFÉ declines all liability with regard to any message that breaches the above rules.

However, the company CHAMPAGNE STANISLAS BONAFÉ reserves the right to refuse any message that breaches any of the above rules. In such a case, the company CHAMPAGNE STANISLAS BONAFÉ will contact the Buyer to request that they modify the content of their message. Should the Buyer fail to submit a new message that complies with the above rules within 7 days of being contacted by the company CHAMPAGNE STANISLAS BONAFÉ, the Buyer will receive the non-customized (standard) product and the company CHAMPAGNE STANISLAS BONAFÉ will refund the Buyer the additional amount that may have been paid for such customization.

The Buyer expressly and irrevocably undertakes to indemnify the company CHAMPAGNE STANISLAS BONAFÉ upon first request for all consequences and damage in the event of claims from third parties and/or any judgment on whatever grounds, whether contractual, tortious, or otherwise, brought against the company CHAMPAGNE STANISLAS BONAFÉ in relation to the content of the customization message.

Lastly, in accordance with Article L221-28, 3° of the French Consumer Code, the right of withdrawal provided for in Article 7 of these GTC does not apply to the purchase of Products subject to customization.

2-1.3: STEPS TO COMPLETE AN ORDER

For the first order placed on the Website, any new Buyer must create a “customer account” with the company CHAMPAGNE STANISLAS BONAFÉ and complete all the required fields (namely: last name, first name, email address, telephone number, address and date of birth).

After selecting the Products they wish to purchase and before confirming the order, the Buyer must verify the contents of their order. The Buyer will then be redirected to a secure page in order to proceed with full payment of the order. The Buyer is informed that placing an order entails an obligation to pay.

The sale shall be deemed concluded upon validation of the order, after the Buyer has duly provided all necessary information and banking data required for payment. The Buyer’s validation of the order constitutes an electronic signature which, between the parties, has the same value as a handwritten signature.

The Buyer’s order must be confirmed by the company CHAMPAGNE STANISLAS BONAFÉ by sending an email.

2-2. SPECIFIC FEATURES OF “EN PRIMEUR” ORDERS

2-2.1: Characteristics of “en primeur” orders

Sales are valid while stocks last. The Customer acknowledges having taken note of the nature, purpose and essential characteristics of the “en primeur” Champagnes available on the website www.champagnestanislasbonafe.com , and having requested and obtained all necessary and/or additional information in order to place the order in full knowledge of the facts.

The Customer is solely responsible for their choice of “en primeur” Champagnes and their suitability for their needs, so that the company’s liability cannot be sought in this regard.

Title to the “en primeur” Champagnes ordered will transfer only after effective and full payment of these by the Customer; such payment includes the payment of the net price excluding taxes, the applicable taxes and, where applicable, delivery and/or storage costs.

The acceptance of the order form binds the Customer.

2-2.2: Collection or Delivery of “en primeur” sales and availability of goods

The company informs the Customer of the date on which the ordered “en primeur” Champagnes will be made available when sending the invoice relating to the applicable taxes. This invoice includes a balance to be paid, consisting of VAT and any additional bottling, packaging and shipping costs. Payment of this balance is a prerequisite for the delivery of the “en primeur” Champagnes. The Customer then has a period of three (3) months to collect the ordered Champagnes from the company, or to request delivery at their own expense. Once this period has expired, the company may charge the Customer storage fees. If the Champagnes are not collected within the allotted period, the company further reserves the right to apply the provisions of the French Civil Code pursuant to which the contract is automatically terminated. Similarly, after the deadline, the company is not bound by an obligation to preserve the wines and therefore cannot be held liable for any potential deterioration of the wines.

Collections or deliveries take place from Monday to Friday, excluding public holidays.

If the company CHAMPAGNE STANISLAS BONAFÉ is unable to supply the ordered goods, in particular due to a stock shortage, the order shall be deemed canceled. The company CHAMPAGNE STANISLAS BONAFÉ will then inform the Customer of the cancellation of their order.

In the event of a temporary stock shortage, the company CHAMPAGNE STANISLAS BONAFÉ may propose that the Customer postpone their order to an agreed date.

Article 3: PRICES

Prices are expressed in euros (€), including all duties and all taxes (VAT included) for delivery within French territory. The Products are invoiced at the price including VAT to which must be added any applicable transport costs on the date of the order, and any customization costs where applicable, as well as any technical fees. The prices indicated on the order after its validation are firm and final and may not be revised under any circumstances, even in the event of a decrease or increase in the price of the Products after the order.

Transport costs are invoiced to the Buyer depending on the quantities and the place of shipment. Transport billing is based on a calculation rule taking into account the destination on the one hand and the weight of the parcel on the other hand. All prices indicated are expressed in euros, inclusive of all taxes and charges, including VAT at the rate in force on the day of delivery.

Article 4: PAYMENT

4.1: PAYMENT METHODS

Payments are made after final validation of the order. Payment is made, unless otherwise stipulated, exclusively online via the secure payment platform of our partner Stripe.

Payment is made by bank card (Visa, Mastercard, and any other cards that may be accepted by Stripe at the time of payment). The entry of banking information is carried out via a secure page operated by Stripe, thus ensuring the security and confidentiality of the information supplied during the transaction. This data is in no case communicated to the company CHAMPAGNE STANISLAS BONAFÉ.

The Buyer declares that they are authorized to use the bank card chosen for payment of their order and that they have sufficient funds to pay said order. The choice of this method of payment implies tacit acceptance of Stripe’s terms and conditions of use of its payment service, which the Buyer is invited to consult directly with this service provider.

Under no circumstances may the sums paid be considered as deposits or down payments.

4-2: SUPPORTING DOCUMENTS

Before confirming an order, the company CHAMPAGNE STANISLAS BONAFÉ reserves the right to request that the Buyer provide proof of identity, place of residence and the means of payment used, for fraud prevention purposes. In such a case, processing of the order will begin upon receipt of these documents. The company CHAMPAGNE STANISLAS BONAFÉ reserves the right to cancel the order in the absence of receipt of such supporting documents or in the event that the documents received are deemed non-compliant.

Article 5: RETENTION OF TITLE

THE COMPANY CHAMPAGNE STANISLAS BONAFÉ EXPRESSLY RESERVES TITLE TO THE PRODUCTS SOLD UNTIL FULL PAYMENT OF THE PRICE BY THE BUYER AND EFFECTIVE COLLECTION OF SUCH PAYMENT BY THE COMPANY CHAMPAGNE STANISLAS BONAFÉ.

Article 6: SHIPPING OF PRODUCTS

Deliveries are only made in mainland France, Corsica and Monaco. It is the responsibility of the Buyer to organize the delivery of products purchased to a delivery point outside the covered area, to ensure compliance with the regulations in force at the place of importation, and to pay any applicable taxes and other costs.

6-1: DELIVERY TIMES

The Products are delivered to the address indicated on the order by the Buyer, who remains responsible for the quality and accuracy of the information provided. The delivery times, from the confirmation of the order, are as follows:

Standard delivery: 15 business days.

When orders are destined for Corsica, an additional period of 7 DAYS must be allowed.

When the order is dispatched, the Buyer receives a link from the carrier allowing them to track the delivery. The company CHAMPAGNE STANISLAS BONAFÉ invites the Buyer to report any delivery delay exceeding four (4) days compared to the delivery date indicated on the order confirmation, in order to enable it to initiate an investigation with the carrier. In any event, the company CHAMPAGNE STANISLAS BONAFÉ will keep the Buyer informed of the outcome of the investigation without prejudice to the Buyer’s right to cancel the order, by registered letter with acknowledgment of receipt, after having requested the company CHAMPAGNE STANISLAS BONAFÉ to deliver the Products within an additional reasonable period by registered letter with request for acknowledgment of receipt. In such a case, the company CHAMPAGNE STANISLAS BONAFÉ will reimburse the Buyer any sums paid within a maximum period of twenty-one (21) days from the date on which the sale was terminated.

By express agreement, a case of force majeure as defined by the case law of the French Court of Cassation, preventing delivery, may not be attributed to the company CHAMPAGNE STANISLAS BONAFÉ. The company CHAMPAGNE STANISLAS BONAFÉ will keep the Buyer informed in due time of any occurrence of events of force majeure.

6-2: TRANSPORT

The company CHAMPAGNE STANISLAS BONAFÉ remains entirely free to choose the carrier. The company CHAMPAGNE STANISLAS BONAFÉ bears all risks related to transport up to the point of delivery, that is to say, until the physical handover of the Product(s) ordered to the Buyer or their representative, who accepts them. The Buyer must then check the order upon receipt in the presence of the carrier and, if necessary, record any reservations in writing on the delivery slip or the carrier’s consignment note, in accordance with the procedure described below.

The Buyer must refuse delivery if the parcel is damaged or if items are missing. In the event of damage, the Buyer must make precise and detailed written reservations on the delivery slip or the carrier’s consignment note, in the presence of the carrier or their employee (it being specified that general reservations such as “subject to unpacking inspection” have no value). The Buyer must then send the carrier a registered letter with acknowledgment of receipt restating the reservations within three calendar days following delivery. Goods accepted without reservation by the Buyer at the time of delivery and/or in the absence of a letter sent to the carrier within 24 hours are deemed to have been delivered in good condition and in full. For any question or difficulty regarding delivery, the Buyer is invited to contact the company CHAMPAGNE STANISLAS BONAFÉ.

Article 7: RETURN RIGHTS

In accordance with Articles L221-18 et seq. of the French Consumer Code, all consumers have a period of fourteen (14) calendar days from receipt of the Products to return all or part of the order. Where the 14-day period expires on a Saturday, Sunday or public holiday or non-working day, it is extended until the next working day. The Buyer shall inform the company CHAMPAGNE STANISLAS BONAFÉ of their decision to withdraw by sending the withdrawal form attached to the order confirmation email, or any other unambiguous statement expressing their wish to withdraw.

The Buyer undertakes to return the Products no later than fourteen (14) days following communication of their decision to withdraw, to the following address: CHAMPAGNE STANISLAS BONAFÉ 2 BIS RUE JULES LOBET 51160 AY CHAMPAGNE.

The Buyer must return the Products strictly in their original condition and packaging together with the duly completed withdrawal form, a copy of the invoice and the accompanying document, if any. Any damaged Product will not be taken back, exchanged or refunded.

This right of return is exercised without penalty and without cost, except for the return costs which remain payable by the Buyer. In the event that the right of return is exercised, the company CHAMPAGNE STANISLAS BONAFÉ undertakes to reimburse the Buyer all sums paid, including delivery costs, no later than fourteen (14) days from the date on which the company CHAMPAGNE STANISLAS BONAFÉ is informed of the Buyer’s decision to withdraw, subject to proper receipt by the company CHAMPAGNE STANISLAS BONAFÉ of the Products. The refund will be made using the same method of payment as that used by the Buyer for the order.

In the event of return of the entire order, the company CHAMPAGNE STANISLAS BONAFÉ will refund the delivery costs related to that order. In the event of partial return of the order, the company CHAMPAGNE STANISLAS BONAFÉ will not refund the delivery costs relating to that order.

The right of withdrawal cannot give rise to the payment of any indemnity or penalty whatsoever.

Article 8: CLAIMS AND WARRANTIES

The company CHAMPAGNE STANISLAS BONAFÉ is liable for any lack of conformity of the Products delivered with respect to the order, under the conditions set out in Article L. 217-4 et seq. of the French Consumer Code, and for hidden defects in the Products sold, under the conditions set out in Articles 1641 et seq. of the French Civil Code.

For any claim, the company CHAMPAGNE STANISLAS BONAFÉ invites the Buyer to contact it by e-mail: {store.support_email}. Any claim relating to a defect in the delivered Products, an inaccuracy in the quantities or incorrect references compared to the order confirmation issued by the company CHAMPAGNE STANISLAS BONAFÉ must be sent to the company CHAMPAGNE STANISLAS BONAFÉ by registered letter with acknowledgment of receipt within 72 hours from receipt of the Products, without prejudice, where necessary and in accordance with Article 6-2 of the GTC, to any recourse against the carrier. The Buyer has a period of five (5) calendar days from delivery of the Products to return any non-conforming Products to the company CHAMPAGNE STANISLAS BONAFÉ. Any non-conforming Product must be returned in its original packaging, accompanied by a copy of the invoice and any other document that may have been supplied.

If repair or replacement is not possible, the company CHAMPAGNE STANISLAS BONAFÉ will offer the Buyer either cancellation of the order and reimbursement of the sums paid – except in the case of a minor lack of conformity – or retention of the Products with partial refund of the price. The cost of returning the Product(s) ordered and delivered as well as any delivery of another Product will be borne by the company CHAMPAGNE STANISLAS BONAFÉ.

The reimbursement or any credit note (including return costs) will be issued upon receipt of the Products whose non-conformity has been duly established and accepted by the company CHAMPAGNE STANISLAS BONAFÉ. Any costs incurred for returning Products for any reason whatsoever are payable by the company CHAMPAGNE STANISLAS BONAFÉ. Products or accessories that may be customized will not be taken back, exchanged or refunded. No claim can give rise to the payment by the company CHAMPAGNE STANISLAS BONAFÉ or its suppliers of any indemnity or penalty of any kind whatsoever.

Article 9: INTELLECTUAL PROPERTY

All elements of the Website, whether visual or audio, the trademarks and/or logos of the company CHAMPAGNE STANISLAS BONAFÉ or its suppliers, texts, layouts, illustrations, photographs, documents and other elements, including the underlying technology, are protected by intellectual property rights (copyright, trademarks, patents, etc.). They are the exclusive property of the company CHAMPAGNE STANISLAS BONAFÉ and/or the suppliers of the Products. Any copy, adaptation, translation, representation or modification of all or part of the Website is strictly prohibited without the prior written consent of the company CHAMPAGNE STANISLAS BONAFÉ. Any reproduction, even partial, of the elements of the CHAMPAGNE STANISLAS BONAFÉ Website without the written consent of the company CHAMPAGNE STANISLAS BONAFÉ is prohibited.

Article 10: DATA PROTECTION

The company CHAMPAGNE STANISLAS BONAFÉ is the data controller for the processing of personal data (“Data”) collected and processed in the context of the sale of products to the Buyer. The Data (namely, last name, first name, postal address, email address, telephone number, banking information, purchase history) are necessary for the processing of their order and are kept for three years from the end of the commercial relationship or, in any event, for a period not exceeding the applicable statutory limitation periods. The Data (i) will be archived for accounting and evidential purposes for the above-mentioned limitation periods or (ii) will be destroyed once said periods have expired. The Data will not be transferred or made accessible to any third party except (i) any subcontractors of the company CHAMPAGNE STANISLAS BONAFÉ involved in the performance of this order and (ii) as part of any restructuring and/or reorganization operation carried out by the company CHAMPAGNE STANISLAS BONAFÉ.

The Data collected is intended to respond to the Buyer’s queries regarding the products; to manage orders, their delivery and payment; to manage and optimize the customer relationship; and to produce statistics.

The company CHAMPAGNE STANISLAS BONAFÉ may be required to disclose Data to third parties where such disclosure is required by law, regulation or court order, or where such disclosure is necessary to ensure the protection and defense of its rights.

In accordance with the regulations in force, the Buyer has the right to access and rectify their Data, as well as the right to request their erasure, to object to their processing and to obtain restriction or portability of their Data where applicable. The Buyer may also object to the use of their Data for profiling purposes. Furthermore, they may at any time request to no longer receive communications by using the opt-out facility provided for this purpose in each message sent to them.

These rights may be exercised directly with the company CHAMPAGNE STANISLAS BONAFÉ by sending a simple letter to its registered office or by email to the following address: [OFFICIAL EMAIL ADDRESS TO BE COMPLETED]

Article 11: INVALIDITY OF A CLAUSE

Should any clause of the GTC be considered null and void, the other provisions of the GTC shall continue to be fully valid and effective.

Article 12: DISPOSAL OF EQUIPMENT WASTE

In accordance with Article L541-2 of the French Environmental Code, it is the responsibility of the waste holder to ensure or have ensured the disposal of such waste. The Buyer ensures the collection, treatment and recovery of the equipment.

Article 13: DISPUTES

13-1: APPLICABLE LAW

Any dispute relating to the interpretation and performance of the GTC shall be governed by French law. The application of the Vienna Convention on the International Sale of Goods is expressly excluded.

13-2: EVIDENCE AND NON-WAIVER

Electronic records and files of the company CHAMPAGNE STANISLAS BONAFÉ shall be considered by the parties as proof of communications, orders, payments and transactions between the parties, unless proven otherwise.

The fact that the company CHAMPAGNE STANISLAS BONAFÉ or the Buyer does not invoke, at any given time, any of the clauses of the GTC may not be construed as a waiver of the right to invoke the same clauses at a later date.

13-3: COMPETENT JURISDICTION

In the event of a dispute and following an unsuccessful written claim made by the Buyer to the company CHAMPAGNE STANISLAS BONAFÉ or in the absence of a response from the company CHAMPAGNE STANISLAS BONAFÉ within one (1) month, the Buyer may resort to any alternative dispute resolution method and, in particular, to mediation. The Buyer remains free to accept or refuse mediation and, in the event of mediation, each party remains free to accept or refuse the solution proposed by the mediator.

If the Buyer waives mediation or refuses the solution proposed by the mediator, the dispute shall be brought before the courts chosen by the Buyer (either the courts with territorial jurisdiction under the French Code of Civil Procedure, or the courts of the place where they were domiciled at the time of conclusion of the contract or at the time of the harmful event), even in emergency proceedings, with third-party claims or multiple defendants.
